New standards for on demand delivery workers

If you deliver food, groceries or drinks through an app, operate a delivery platform, or run a business that uses these services, new minimum standards are now in effect.

The standards apply to eligible independent contractors who accept and complete on-demand deliveries through an app or website. They also apply to the delivery platforms that engage these workers.

The new requirements cover:

• minimum pay rates

• vehicle repairs, registration and expenses

• record-keeping

• fines and insurance

• information provided to workers

• the right to unpaid time away

• dispute resolution.

Minimum pay is based on engaged time, from accepting a delivery until it is completed. Until 31 December 2026, rates range from $31.30 to $32 per hour of engaged time, depending on the vehicle used.

What does this mean for your business?

If your restaurant, cafe or retail business uses a delivery app, the standards generally don't create direct obligations for you.

For example, when a customer orders a meal from your business through an app, the standards apply to the delivery worker and the platform operator that engages them.

It's still a good idea to check any information from your delivery provider about the changes and how they may affect the service.

If you operate a delivery platform or directly engage delivery workers, check whether the standards apply and what you need to do.
